強執80-1I 於前段無益執行時,債權人可依同條項中段來硬幹,
但中段要件如何解讀才對?
甲說:函授上是這樣寫
1.受通知後七日內
2.證明賣得價金有剩餘可能or指定較高底價
3.聲明願負擔拍賣費用
乙說:我自己說.... 我看起來比較像
1.受通知後七日內
以下二擇一
2-1 證明賣得價金有剩餘可能
2-2 指定較高底價,並聲明願負擔拍賣費用
指定較高底價聲請拍賣者要聲明負擔執行費用,這個OK,畢竟是執行債權人執意要玩!
但證明賣得價金有剩餘可能者,是否也要聲明之?
想法:既然都證明清償優先順位及執行費用後還有剩了,為什麼還要要求債權人聲明?
