公家機關沒有幫員工保勞健保?! - 職場

之前輾轉聽到朋友說 他有個朋友在中南部某國立大學附屬醫院工作
可是卻沒有幫他保勞健保
而且還是竟然合法的?!
朋友說 因為他們是用「自然人承攬」的方式 迴避法律
原本可以合法不保勞健保的狀況是 外包員工
也就是雖然在A公司工作 但身份是歸屬在外包的B公司
B公司要幫他保勞健保
但所謂的自然人承攬
就是假設「你自己當自己的老闆來承包這個工作」
所以你自己要負責自己的勞健保
可是該朋友又沒有自己開公司 怎麼幫自己保?
通常可以透過職業工會,但他們那種類別的醫事人員沒有工會。
所以他就真的完全沒有勞健保...........
聽到還蠻驚訝的.....公立機關耶....還可以這樣搞的喔??
這樣真的沒有違法嗎?!
有沒有人遇過一樣的狀況的啊?!
