想請問一下一個老題目
甲賣乙土地,甲交付土地後,土地被徵收,乙是否可以拒絕交付價金?
依照373條,交付後,應該由乙負擔價金危險
所以乙仍應該給付價金
為免不公,乙另外走225條第二項
可是看到林政豪解題書寫,(實務見解認為373之危險係指物之毀損消滅,不包含徵收)
故乙可以依266條免於對待給付
麻煩幫我解惑一下
