更改薪資結構與給付方式 - 職場

公司之前都是直接匯全薪給員工,但從上個月開始公告要改為只匯基本工資,
剩下的以美金湊成全薪給員工。
舉例:
本薪應為35000,改為匯20008元新台幣,差額以美金補齊。
而且公司稱差額部份為"獎金",
但多年來公司明明都是發足額的新台幣本薪,並沒有底薪+獎金這回事。
請問:
若這樣的方式並沒有另外和員工簽勞動契約,是否屬違法行為呢?
