這個問題是去年賴老師上課所說的
我已經重複聽了好幾遍
還是弄不出個所以然@_@
承攬人之抵押權
*甲(定作人)與乙(承攬人)訂有承攬契約,乙幫甲在其地(A地)興建房屋(B屋)
後來甲未付價金,請問乙可以於A地或B屋登記設定抵押權?
老師給的答案是A地
*承上題
後來因為甲向丙借款,用A地與B屋抵押給丙,則乙可以A地或B屋登記設定抵押權?
老師給的答案是B屋
請問前後乙可登記的標的物不同
是因為A地被丙設定抵押權嗎?
還是哪條法條有規定?
希望有人可以幫我解釋一下513條
因為老師說很重要!
