小弟在書上看到一題,不是很懂,想像大家請教一下
甲於民國70年有一地賣給乙,土地以交付,但未辦理移轉登記,價金亦仍未付清。
89年時,甲請求乙返回該地,以請求甲移轉該地所有權,甲乙之請求,各有無理由?
1.乙請求甲移轉土地所有權,因請求權時效消滅,故甲可以拒絕辦理所有權移轉登記。
2.甲請求乙反還土地,依照民法767前段,乙要無權占有為要件。按乙對甲之所有權移轉登
記請求權時效消滅,只是甲有拒絕給付之抗辯權而已,原有的債權債務關係並不消滅。且乙占甲的土地,乃甲本於有效之契約而交付,
具有正當權源,非無權占有。故甲不得依767請求乙反還。
以上為書本上大致的解答
我想問的是,依758的規定,不動產物權,依法律行為而取得、設定、喪失及變更者,非
經登記,不生效力。
既然未登記,那乙為何可取得所有權?還是契約一生效,就會取得所有權?但是買賣契約,是負擔行為,債權行為,不生權利義務的變動,那甲與乙的契約有沒有效,對於
乙取得土地的所有權,不是應該沒關係嗎?
