先說一下背景
小弟的上司是老板多年好友的小孩,小弟一直跟他處不來,也有過幾次口角
他是這裡(上海)的最高主管,依組織架構,我(管理部兼財務部)是掛在他下面
由於兩人的關係一直處於緊張狀態,除了沒有任何私交外,工作上也會互抓小辮子
直到最近老板發來一封MAIL表明由於以下幾點,要資遣我
1.XXX是駐地最高主管,負責所有的成敗,你是他的部屬,基於職場倫理,只要是不違法
及影響公司利益前題下,你要主動配合
2.XX公司只有兩位台灣籍幹部,在公事上你們不同心,嚴重影響公司士氣,甚至讓其他同
笑話
3.這兩年XX公司都有達到預期目標,我沒有理由更換駐地最高主管
基於以上理由我只能跟你說抱歉
想請問各位大大,上面三個理由,哪一個是屬於勞基法第11條所規定資遣員工的範圍呢??
雖然我知道很多人會說老板叫你走有無數個理由..........
上市公司老板都很會算................也不知道願不願意付資遣費..............
還有,我要領非自願失業證明嗎??未來我找工作應該也不會在台灣..........
