關於公有公共設施音設置或管理有欠缺，致人民受損害之國家賠償責任，
下列敘述何者錯誤？ 答案給A
A.供公眾使用之道路、橋梁、公園等，在施工建造中亦屬公共設施
我現在翻課本 上面有肯定說和否定說
否定說(林三欽、董保城、李惠宗)
驗收僅是承攬工作業者與委託機關間之私法契約履約行為，與人民無關，只要有提供公用
事實即可
老師上課有講我記得很清楚的
嗚嗚~~~怎麼會錯了
然後行政學現在對答案，發現考試時鬼遮眼，當時明明看到是問「下列者錯誤」，現在
看變成「何者正確」......崩潰中...
