這問題是小弟自己想到的
A、B共同決議要傷害甲，A動手，B把風，後A傷害甲致死
B說：「我當初就預見到甲會被A失手死」
A應該是加重結果犯無疑，傷害致死。
A→傷害(故意)，死亡(過失)
B是共同正犯，但應該論以過失致死還是殺人既遂之共同正犯?
B並不是具有預見可能性的問題
B已經直接預見了甲的死亡，而且也不反對這樣的結果發生
(未必故意、間接故意，論故意)
B在對甲的結果上，對傷害、死亡都有故意
B→傷害(故意)，死亡(故意)
我想到
1. B雖有未必故意，但A與B的行為決議是傷害，故B仍論傷害致死之共同正犯
2. A與B的行為決議雖是傷害，但B預見A之死亡具故意，故論以殺人既遂之共同正犯
何解??
