勞工申訴 不准秋後算帳

這次勞基法修法,立法院堅持訂「吹哨者條款」,明訂雇主若因勞工申訴而解僱、降調、
減薪等不利處分,將為無效,給勞工最大靠山。
原有勞基法規定雇主不得因勞工申訴,而予以不利處分。但在實際上,勞工檢舉違法雇主
,有時因勞檢技巧不當,或是公務員不小心洩露檢舉勞工身分,致檢舉勞工身分曝光,遭
老闆秋後算帳。
為鼓勵勞工檢舉不遵守勞基法的雇主,新法增訂吹哨者條款,明訂雇主若因勞工申訴而解
僱、降調、減薪等不利處分,將為無效。
其次,新勞基法明訂,主管機關或檢查機構接獲申訴後,應於60日內將處理情形以書面通
知勞工,且不得洩漏申訴人身分資料,違反者,除應依法追究公務員之刑事及行政責任,
對受有損害勞工,並應負損害賠償責任。
勞陣秘書長孫友聯指出,過去勞工檢舉雇主,若是在小公司,員工很少,雇主很容易猜出
來,「就是很難剃頭的那個」,往往會遭到雇主秋後算帳;現在勞動新制對檢舉勞工多了
一層保障,勞團表示肯定。
熟悉勞基法的人士說,檢舉勞工權益保障,包括雇主不得採取不利處分之申訴,勞基法施
行細則已有相關規範,而公務員洩密的責任追究,在相關法令也有規範;但勞基法新規定
有「強化」效果,尤其是,明訂「雇主若因勞工申訴而解僱、降調、減薪等不利處分,將
為無效」,使得勞工對雇主進行訴訟時,站在非常有利的地位。
舉例來說,某勞工因檢舉雇主違法,事後遭老闆降薪處分,該勞工可向當地勞動主管機關
申訴,經查屬實,依勞基法第22條開罰,要求雇主給薪並且限期改善,若雇主不改善再罰
,官員說,多數的勞資爭議都可在此階段獲得解決。
惟雇主限期不改善,抵死不從,罰不怕,因雇主繳的罰鍰到行政機關,勞工仍然拿不到薪
資,勞工可爭取自己民事權益,對雇主進行民事訴訟;而勞基法新制就給了勞工極為有利
之保障。
