外派約聘可否報加班? - 加班

大家好
想問一下根據勞基法還是哪些規定
如果是外派的約聘人員超過工時可否申請加班?
我有問過外派公司以及現在上班的hr
兩邊都跟我說只要是因為不可抗因素(如遇開會或老闆交代事項)而加班
不是因為個人的問題而造成晚下班(如太晚上班所以延遲到下班時間)
是可以照正職人員申請加班的
只是會是用補修時數的方式,而非變成薪水
我今天本來要給我主管簽約聘的時數表
他看了之後說他記得給約聘的package是不能報加班的
叫我打電話問公司的hr
我問了告訴他說hr說可以 外派公司也說可以
他竟然拒簽然後說他要明天在問問看再告訴我.....
如果外派約聘不能報加班也太點了吧....
正職的福利都沒有連年終也只有半個月(不到一年還要照比例給)
這樣真的合法嗎.....
