朋友在某間連鎖美妝店工作,未滿三個月
之前有請辭一次但被慰留
後來前幾天店長找她談,根據他的說法是 店長在對話中意圖套她自己主動提離職
因為我朋友本來也就不太想做了,後來跟店長說,那就做到這個月底
店長也同意了
後來過兩天,店長跟我朋友說,你就做到今天,明天不用來了
資方先前已經答應過勞方要做到這個月底
這期間我朋友也沒有曠職、偷竊、損害資方權益
資方怎可違反允諾?
問過勞工局,得知勞基法中寫到勞工就職未滿三個月 資方可以不經預告要求勞工離職
但資方之前已答應過勞方可作到月底,即使是口頭上的承諾也構成契約
如果這部份有爭議,屬於民事上的「未履行契約」的部份
可以申請勞資爭議協調
目前我朋友已去申請勞資爭議協調了
我現在的想法是
爭取公司必須給足到原預定離職日的薪水,
不然就讓我朋友繼續工作到原預定離職日(或同樣的工作天數)
請問這樣的訴求合理嗎?
資遣費可以爭取嗎?公司是有說會依規定給資遣費
但我朋友才做沒多久,資遣費也不多,她只想要好好工作完領全薪
