最低薪資月薪與時薪計算差異 - 加班

想請問一下,之前在打工是給時薪,班不算穩也比較像是幫老闆卡位放假,今年調漲到176,而月薪現在是26400
然後親戚目前想請我上月薪班
週一至五10~17,他再來接晚上
週六日10~21
月休六天會挑平常日,還有全勤跟業務獎金
時間抓四個禮拜配每月不固定的2~3平日/週末
4[(7*5)+(11*2)]+(14~29)
也就是一月至少是242~257
休假六天再扣除42所以是200~215
然後我突然想到26400其實是一個月固定算工作日把時薪176乘與工時150的結果
好像又聽說有人給的算法是26400除與30天,平日週末休假也有給薪,這點我是保持懷疑態度
畢竟放假也有錢領這句只符合「特休」而不是全都有
這樣只給基本工資再去看時數實際上是不符合勞基法的的對吧?
我應該跟親戚談多的時數算加班費或是不算月薪合理的176嗎
不過換個角度想,轉月薪制瘋狂上班好像還不如之前上假日班時薪的感覺,口頭上保證的業績跟全勤獎金在時薪滑到132的時候好像就沒優勢了
小店面老闆跟我兩個人一起沒有勞健保就似乎應該給更多,但這個部分我更不知該怎麼算了
或許這也是目前請不到人的問題?
超長工時中間無法休息(八~十一小時顧店,都很閒也很忙)
我這樣會算得太精嗎?
