60 年台上字第 4195 號判例:
未登記之土地無法聲請為取得地上權之登記,故依民法第七百七十二條準用同法第七百六十九條及第七百七十條主張依時效而取得地上權時,顯然不以占有他人未登記之土地為必要。苟以行使地上權之意思,二十年間和平繼續公然在他人地上有建築物或其他工作物或竹木者,無論該他人土地已否登記,均得請求登記為地上權人。
想請問「未登記之土地無法聲請為取得地上權之登記」
是怎麼推論出
「顯然不以占有他人未登記之土地為必要。」
想了很久都看不懂,求解
