丁守中質疑，選罷法規定選前10天不得散布民調，但台北地院卻認定「邊開票、邊投票」民
眾，排隊等候時觀看手機資訊只是「事實現象」，不會影響選舉人票行為，錯誤認定事實。
丁表示，簽注樂透時邊報明牌與邊開獎，當然後者更為嚴重。
爭點在於邊投邊開是否會影響選舉人？
選罷法的規定是認爲民調會影響所制定。
同理，丁守中案應可類推適用，但還有一個關鍵
因，該如何證明因果關係？今天不論票改投誰，
只問是否會影響投票意願，但缺乏證明因果的證據，
以此反推，選罷法民調不也無法證明因果嗎？我認爲丁主張有理，各位怎麼看呢？
