我以為是公立醫院清潔傳送、台電台水抄錶、台糖台酒
萬萬沒想到竟然是傳說中郵局,但你後面再說我就覺得很像郵局的玩法
一般機關的業務承攬大多是換約不換人,也就是我這一包沒包到
下一包進來時,外包商會換管理幹部,但員工和資產交接給下一間公司
錢的算法就我上面說的那樣,所以會有管銷的成本和履約的檢查
但是郵局玩法與眾不同,他的人來去非常頻繁
外包商公然在人力網上用兼職的名義招各郵局的外包人力
當然,你說這沒有郵局的默許嗎?
中華郵政的公會有提出過
建請本會促請總公司全面進行外包制度檢討與改進,禁用現行外包制度,將現有外包制度
全面檢討改進為不定期契約工制度。
建請中華郵政公司各責任中心局以自然人承攬外勤郵件投遞工作人員,依據勞基法之精神
,納編為公司約僱人員身份,以落實對勞工應有的的保障。
回答是什麼?
依據人力資源處 104 年 5 月 20 日回覆如下:一、 本公司為配合政府組織精簡政策控
管員額依照行政院所頒「行政院及所屬各機關推動業務委託民間辦理實施要點」等政策法
令規定,將部分業務辦理委外。二、 因本公司現有核定員額不敷業務所需人力,為減輕
員工工作負荷及因應郵件進出口時段不同之彈性用人,部分業務仍需持續辦理委外,以維
持業務正常運作。三、 自然人承攬部分,本公司將於現有員額允許情況下,持續檢討減
少投遞業務區段委外。四、 本案保留。
也就是讓承攬商可使人為奴的合約才是郵局要的,因為他非常怕這些外包承攬人員會
自認為自己是郵局的人,所以他要找一個白手套來替他找自然人承攬

正常的玩法是什麼?
可以看一下經濟部的合約範本
勞務採購契約範本 案號:105-02-01 (102.12.12 修正)
勞動派遣(指派遣事業單位指派所僱用之勞工至機關提供勞務,接受各該機關指揮監督管
理之行為):
1. 廠商對於派遣勞工(指受派遣事業單位僱用,並向各機關提供勞務者)
之薪資(內含勞工依法自行負擔之勞、健保費用),應依契約約定之金額,核實給付。
2. 廠商負擔之勞工保險費、積欠工資墊償基金、全民健康保險費及勞工退休金,由機關
依契約規定之金額支付廠商,但派遣勞工如因其年齡或身份條件屬依法免投勞健保、繳納
各項費用,或廠商未依法為其勞工投保、繳納各該費用者,該項費用於給付時扣除,不另
支付廠商。
我說過了,顧主的部份負擔,在公家機關來說本來就是算在勞工身上
沒有合不合法,他本來就是管銷成本
廠商收到機關提供之出勤紀錄,至遲應於_工作日(由機關於招標時載明;未載明者,為
2 工作日)內向機關提出前月止所發生費用之請款單及相關證明資料等文件,證明資料
應包含已為員工繳納法定保險費之證明(於勞工保險局、中央健康保險署列印之派遣勞工
之勞健保投保薪資、勞退月提繳工資等)及薪資匯入員工帳戶之匯款證明等
看到了嗎?
正常的承攬是不能不保勞保,因為沒有投保清冊,一毛錢也請不到
但是郵局呢?

一、依行政院 人事行政總處101年3月6日總處組字第1010025247號略以「…民法第490條
第1項規定,稱承攬者,謂當事人約定,一方為他方完成一定之工作,他方俟工作完成,
給付報酬之契約。勞務承攬就投標廠商之類型,可再區分為廠商承攬與自然人承攬;至自
然人承攬,依採購法規定,自然人亦得為投標廠商,且自然人承攬者,非屬勞工身份,自
不適用勞動基準法等相關法令規定。」
他是故意要用自然人承攬的方式,讓這些人吃大便啊....
甚至被勞檢,被監察院糾正
糾正案文
1、被糾正機關:中華郵政股份有限公司。
2、案 由:中華郵政股份有限公司持續發生違反勞動基準法相關規定之情事,諸如
未詳實記載員工之出勤時間,亦未核實給付逾時工資等情,郵務從業人員之合法勞動權益
屢遭侵害;又該公司招標辦理自然人承攬郵件投遞工作,經勞動部實施勞動檢查發現「以
承攬之名,行僱傭之實」,規避勞動基準法,惡化基層勞動者之工作條件,且相關承攬契
約所定承攬人郵件損害賠償責任條款,超逾郵政法規定之郵件補償範疇,亦不符合政府採
購法第6條所揭公平合理原則,均核有違失,爰依法提案糾正。
中華郵政公司招標辦理自然人承攬郵件投遞工作,經勞動部實施勞動檢查發現「以承攬之
名,行僱傭之實」,規避勞動基準法;另相關承攬契約所定承攬人郵件損害賠償責任條款
,超逾郵政法規定之郵件補償範疇,亦不符合政府採購法第6條公平合理之原則,均核有
違失
郵局從頭到尾就知道自己在使人為奴,但是他就是一定要用這招
