有關退休人員再任私校職務且領有一定薪給以上者停發退休金部分，違憲。立即失效。
其餘部分皆合憲。
違憲理由略為：
退休人員在私校部分所領薪資並非皆來自於政府補助，且受政府補助者亦不是只有私校。
立法者做此處理雖然是為了處理雙薪問題，但這樣的區分過於粗略，與憲法保障平等權的
意旨有違。
