離職年假,不給原本該給的天數 - 離職

魯妹102年3月1日報到一家規模20人左右的新公司,今天106年3月1日提出離職,新制勞
基法下我有14天(公司優於勞法,給15天),目前處在手邊沒有計劃,寫信跟老闆說想要
做到3中,其他3月天數就用15天去扣,然後算到3月底做完
老闆回說因為我們公司總是給假優於勞基法,且第一年以進來月份比例給假(10天x %)
累加起來假都比勞基法多,所以我現在要辭職無法給我15天,而是(15x%, 也就是3.75天)
請問這樣違法嗎?還是這樣合理?
