前言:同事A所任職的部門主管朝令夕改,做事不公,傳達訊息往往訊息錯誤,
其實公司內部官官相護,相當黑暗...

進入正題:
同事A於七月最後兩天工作日(7/30、7/31)向公司請特休假住院手術,
(因公司全勤2000,請病假會扣日薪半薪與全勤--病假1天500元*2天=1000元)
因手術較重大,所以再於八月時直接請病假兩周(8/3~8/14,共10天)在家休養,
(因特休天數不足,且剩餘寥寥幾日需先留住以備不時之需,ex:複診等)
請假前已事先向幹部請假,因知幹部處處找麻煩,
只是請個假而已筆者本人也從沒聽說有主管這麼奇怪,下屬須以何種假別請假也要管很多,
為了保險起見A又去電向人資部小姐再三確認與告知:
七月最後2天以「特休假」請假,8月前2周則以「病假」請假,
若部門幹部請示假別錯誤,再請她再次確認後送單。

公司8/10發薪資單,同事本周8/17(一)復工,
卻被主管說不小心拆了他的薪資單(?)
這邊也覺得相當可笑,公司薪資單是機器印出封死的,
名字在封面寫得清清楚楚,怎麼會不小心「拆到」呢?
結果一看薪資單差點沒吐血,A發現他7月的假被請病假,一共又被扣1800!
A知道主管一定又趁這次玩弄他的薪水,所以他直接向人資小姐詢問,
結果人資小姐竟反問:「咦?你不是說要全部請病假嗎?」
然後就無消無息了(人資怕麻煩故意以時間過太久為由不給),
幹部也一直打太極說A自己不講清楚導致如此。(有事嗎?)
但請問,事實真的是這樣嗎?
誰會無緣無故在月底最後全勤2000不拿,讓公司去扣啊?

詢問之下似乎是到處求助無門,
但A家境並不寬裕(底薪僅24K,須靠加班才能勉強到30K),
加上此次手術費用龐大,八月已請了病假10日且公司本月開始嚴禁加班,
(八月至少會再扣日薪半薪500*10+全勤2000=共約7000)
請問以上公司作法是否違反勞基法?是否有申訴管道可求償?(至少1800也要回來吧!)
打從心裡同情A,但卻一點辦法也沒有,只能怒在心裡口難開;
想幫忙這位平時以誠待人卻始終遭遇不順的好同事,
麻煩版上各位是否有除了離職外更好的方式?謝謝大家!
