公法暫時權利保護的問題 - 考試

Q:國家考試之應考人對主管機關就其"欠缺考試資格"之認定不服
但如訴願，考試已經結束，該如何救濟?
這牽涉到暫時權利保護制度
我想問的是機關可以做出一個定暫時性假處分嗎?
暫時給予考生准考證考試，之後再審查其不服有無理由
這件事好像只能依行訴第298條第2項 交由法院程序審查後裁定
而不是機關能做的
如果真要找就是訴願法第93條第2項停止執行
請問這是機關適用此條之當然結果嗎?
還是機關其實可以做出定暫時性假處分 只是我沒找到法條而已= =
