勞動契約中約定煽動罷工即解僱有無違法 - 職場

請問一下,雇主在定型化勞動契約中載明約定:
「勞工於服務期間煽動怠工、罷工,致影響雇主營運,雇主得立即終止勞動契約」。
這樣的約定,是否有違反工會法第35條第1項第4款「雇主不得對於勞工參與或支持爭議行
為,而解僱、降調、減薪或為其他不利之待遇。」的規定。
又,若雇主真的因為勞工鼓動其他勞工罷工而以此解僱,則此時依同條第2項「雇主或代
表雇主行使管理權之人,為前項規定所為之解僱、降調或減薪者,無效。」的規定,是否
解僱無效?

“煽動罷工”嗎?會構成契約裡的當然解僱事由嗎?
