是這樣的,我國勞基法有規定休假日上班薪資應加倍給予。
勞動基準法39條全文
第三十六條所定之例假、第三十七條所定之休假及第三十八條所定之特別
休假,工資應由雇主照給。雇主經徵得勞工同意於休假日工作者,工資應
加倍發給。因季節性關係有趕工必要,經勞工或工會同意照常工作者,亦
同。
現在我想問,雇主經徵得勞工同意於休假日工作者,工資應加倍發給。
工資加倍是要怎麼算才對?
現在問題有2個:
第一,如果月薪是3萬,本月工作20天,日薪是1000元還1500元?
第二,假如日薪是1000元,休假日上班當天工資是再多領1000元還是2000元呢?ꀊ
另外我的公司休假日上班都不給加倍工資,強迫以補休方式來算,說累積著
補休等離職時可以換錢,但卻又找平日客人少時給我們排休假,消耗掉之前休假日上班的
補休時數,這樣有違勞動基準法的規定嗎?
