今天詢問公司除夕(2/4)至初三(2/7)是否有給予雙倍薪水
公司回覆沒有,因為已經有把二月的紅字算進去,有多排休四天假給我們了
所以過年期間上班就沒有雙倍薪水,請問這樣是否合法?
我問公司不是只要2/4-2/7有出席上班的人,都要給予雙倍薪水嗎?
公司回覆以往都是這樣,公司將給予過年期間值班人員每班500元春節津貼,沒有雙倍薪水
請問這樣是否有違法?
依照勞動基準法第 39 條
第三十六條所定之例假、休息日、第三十七條所定之休假及第三十八條所
定之特別休假,工資應由雇主照給。雇主經徵得勞工同意於休假日工作者
,工資應加倍發給。因季節性關係有趕工必要,經勞工或工會同意照常工
作者,亦同。
請問輪班制的勞工適用上述勞基法嗎?謝謝
