Hello!
我今天有PO在女版求助,後來salary板主建議我可以來這裡問問。
事情起因是這樣的,
在目前這家公司待了1年又7個月左右,
上個月從美國出差回來,月底領了年終和一月份的薪水。
今天跟老闆提出了離職,就做到2月底,
沒想到老闆開始數落我:
1. 去美國"享受"回來才要辭職,做人這樣是很現實的。
(他大概是怕國外客人知道這間公司流動率很高,
他不知道怎麼解釋)
2. 你都提離職了,就做到2/17號,
後面過年的假期你是沒資格享受薪水的。
其實出差時受了不少氣,現在聽到他的用字更讓我火上加火,
直接回他說依照勞基法,到月底我是可以領一個月的薪水的。
老闆就爆炸了,說這不是勞基法的問題,
是我個人本身這樣子做就不對,還要我寫聲明說做到2/17。
當然我還沒傻到寫出:"我自願做到2/17就離職",
一開始也是想說就好好做到月底,好聚好散,
但是老闆的態度和語氣一副
"你用公司錢去美國玩完就要拍拍屁股走人",
讓我忍不住想翻臉。
想先問問大家,我這樣算不算非自願離職?
因為爬文看到有人說,曾經勞工局的人說有提過離職,
就不算非自願離職?
另外,如果老闆硬要我寫聲明,
有哪些是特別要注意的?
