今天終於有時間可以來整理一下文章
給大家一個比較詳細的過程
腳色:
小弟任職於某星資汽車代理商
從事汽車銷售顧問的工作
年資:2年10個月又23天 (特休剩下兩天)
分成幾個階段
第一階段:公司調職通知與終止勞動契約
2015/05/04 11:00接獲營業所主管通知
總部管理部經理與北區業務部經理要找我
到了會議室之後 管理部經理拿了一張人事異動通知單
內容就是從銷售顧問 調動至 保養廠服務專員 *(注一)
當下我就立刻提出調動五原則 我不接受調職 依法你們必須資遣我
同時在人事異動通知單上面簽了 不同意調動 5/4/2015
兩位經理在當下馬上就否決了資遣的提議
並且要求我在2015/05/05 09:00早上就到新單位報到
我:我不會去新單位報到,而且我會去勞工局進行申訴
經理回:你知道汽車業界有多小,如果你以後還要賣車的話,建議你不要跟公司吵
我:我無所謂阿,總之我把特休休完前我就會去勞工局提出申訴
結束這個會議後 我就上網把剩下的兩天(5/5&5/6)特休給請掉了

2015/05/05 到新北市政府勞工局提出勞資爭議調解
【勞資爭議調解】申請及檢舉案件項目:
填寫申請書 (勞資爭議調解申請書、檢舉函)→交給服務人員→由服務人員開
立收據→完成(此後服務台人員會將該申訴案移由相關承辦人員依法辦理)
有幾個管道可以處理,有些管道可能要處理很久
所以我選擇比較有效率的財團法人新北市勞資關係關懷協會調解
勞工局承辦人員提醒一點很重要
在你休假結束後兩天一定要寄出存證信函(就是不能因曠職三天被解雇)
2015/05/08寄出存證信函 (需準備身分證、印章、影印三份還有錢)
存證信函內容重點:因公司人事異動...(調動前後工作與生效日略)。因公司調動後工作
,與員工原有工作性質差異甚大,且並非本人技術所能勝任。本人根據勞動基準法第十四
條第六款與公司終止勞動契約,以免訟累。
到這邊就完成終止勞動契約的部分了

注一:銷售顧問是業務員,服務專員是保養廠開車進去保養第一個跑出來跟你接洽的那位
第二階段:調解&申請救濟金
2015/05/14 在板橋區勞資關係關懷協會進行調解
調解目標:勞方請求資遣費與非自願離職證明書
在開會前需準備(勞動契約、近六個月薪資和勞保明細)
恩......調解沒有甚麼法律效用
調解建議:建議給予資遣費與非自願離職證明
如果對方不願意同意任何請求,你也沒有辦法獲得甚麼東西
但是必須經過調解,才可以請新北市政府開立離職證明
才有離職證明可以去勞工保險局申請失業給付
這時候詢問調解委員,他說只有請法院裁判,才會有強制力
2015/05/22
拿調解紀錄至新北市政府勞工局申請離職證明 (需準備 調解紀錄、身分證)
內容有一段大概是這麼說的:勞方拒絕調動並請予以資遣。惟資方認並無資遣勞方意思
表示,致調解不成立。本案勞方表示無法自資方處取得非自願離職證明,故向本局申請
開立,惟本局無法認定該員為非自願離職。
拿勞工局開立的離職證明書至勞工保險局申請失業給付
(需準備離職證明、身分證、印章、存摺)
這時候會有一本失業認定申請需知及申辦表單回條
這時候承辦人員會請你到旁邊電腦看全國就業E網找工作職缺
之後去該公司面試,如果面試後還是找不到工作才可通過
第三階段:法律扶助基金會提供協助
因為確定要走上法院裁判,所以必須要請律師寫起訴狀
2015/05/27 法扶會申請扶助
(需準備 財產清單、所得清單,這些都去國稅局就可以申請)
2015/06/01 法扶會同意扶助
內容:
資力部分:雖不符合本會受法律扶助者無實力認定標準,但屬勞動部委託案件,故准予扶
助。(法律扶助法第十條第五款)
案情部分:本件依申請所述,相對人對申請人所為調動,未符合調動五原則,相對人又拒
絕給付資遣費及開立非自願離職證明書,是申請人所請非無理由,惟案情單純
且金額不高,故撰狀即足。
律師事務所
(需準備 調解紀錄、近六個月薪資證明、勞保投保證明、身分證和印章)
把該準備的資料拿事務所助理,大概跟他敘述上面的狀況,律師就會把起訴狀給完成
2015/06/18 律師完成起訴狀
第四階段:法院
2015/06/25 遞狀
(需準備 起訴狀、身分證、印章和裁判費)
民事訴訟法第77-13條:
因財產權而起訴,其訴訟標的之金額或價額在新臺幣十萬元以下部分,徵收一千元;逾
十萬元至一百萬元部分,每萬元徵收一百一十元;逾一百萬元至一千萬元部分,每萬元
徵收九十九元;逾一千萬元至一億元部分,每萬元徵收八十八元;逾一億元至十億元部
分,每萬元徵收七十七元;逾十億元部分,每萬元徵收六十六元;其畸零之數不滿萬元
者,以萬元計算。
2015/07/18 收到開庭通知將在2015/07/29 09:35開庭
2015/07/28 收到資方所撰的答辯狀
2015/07/29 開庭,法官希望能夠和解,但是資方不願意,且因答辯狀太晚才送達,看完
答辯狀後再開庭
2015/08/05 二次開庭
針對請求資遣費用兩造無異議,主要針對調動前後工作內容與薪資進行瞭解
法官宣告言詞辯論終結,將於2015/08/19進行宣判
2015/08/13 收到資方的二次答辯狀
................法官都宣判言詞辯論終結了,你們還答辯幹嘛?
2015/08/19 上網查詢審判結果
被告應給付原告新臺幣陸萬捌仟伍佰玖拾伍元($68,595)及自民國一百零四年七月十八日
起至清償日止,按年息百分之五計算之利息。
訴訟費用新臺幣壹仟元由被告負擔。本判決得假執行。
但被告如以新臺幣陸萬捌仟伍佰玖拾伍元為原告預供擔保,得免為假執行。
如不服本判決,應於送達後20日內,向本院提出上訴狀,並表明上訴理由
(上訴理由應表明一、原判決所違背之法令及具體內容。
二、依訴訟資料可認為原判決有違背法令之具體事實。)
如於本判決宣示後送達前提起上訴者,應於判決送達後20日內補提上訴理由書

這邊大概就是這次跟資方所對抗的全紀錄,雖然還不知道資方還會不會上訴
但這邊應該能夠讓正在吃虧勞方能有更好的保障
本篇對於失業給付的部分可能沒有非常清楚
因為我只領了一期就已經到新公司上班了
在2015/9/15就滿三個月可以再領剩下的2.5個月給付
也感謝Salary板在這段期間提供各項的諮詢
讓我靠PTT & GOOGLE就可以告贏有法務人員的資方
總花費:不到$300 裁判費1000也由被告負擔
接下來就每天等錢進來,拖越多天需要增加越多的利息
