因為不知道要po在什麼板,只能在這裡請教大家
我的薪水是三萬五,這是一開始商量好的,但只有口頭保證沒有書面,因為那時候還
不懂要Offering letter,這是我的第一個失誤。
因為公司急需我上班,所以說好底薪三萬五其他抽成等等之後再商量,那我想互相吧
所以也答應了就先開始籌備salon的第一個月(3/6開始)
基本上前兩個月還未詳談時說的是我的薪水是底薪三萬五加上抽成和團積抽成
到了第四個月總公司跟我說他們決定好我的抽成方式了
「薪資三萬五,總業績達十萬可抽6% 達二十萬可抽7%含團績。」
這就是說如果業績做不管多少只要沒破十萬,我領三萬五, 破十萬我可領四萬。
前五個月我的薪水都有到三萬七,因為還沒有細談加上說好我是可抽團績的,
覺得奇怪之下跟店長確認多次,也跟總公司確認我是可抽團績的,因此我也沒多想,
認為那我的薪水就是正常的。
沒想到!
總公司的人突然問我說我近幾個月的薪水是多少,我說大概三萬六七左右,
結果他就說那是多給的,要按月扣回,我問為什麼,他就說那是人事部弄錯了,
是「薪水三萬五包含團績,若團績兩千那我薪水就是三萬三加團績,
定住在三萬五除非業績破十萬」
我是想跟他們說
我們一開始就沒有仔細的確認過我的薪資算法,那造成誤會我接受,但這是你們內部的
問題我也確認過多次,所以我認為這份責任不該由我來承擔,我們重新討論過並確認
我的薪水制度,我接受你的制度但不接受你要扣除過去多給的薪水。
那想請問這樣的狀況下有什麼條文是規範僱主不能扣薪的呢??
