當年我剛出社會
做了一年多準備離職
離職日跟公司橋不定
因為照勞基法滿一年有七天特休
我剛滿一年所以七天特休都沒放
所以我離職日押七天特休都放完隔天離職日
結果經理跟廠長討論後不同意
跟我說本公司7天特休一律要滿一年一個月後才有
你沒有滿所以沒有七天特休 你不來就是直接曠職論
但是我查過勞基法也打電話去勞工局問過
法律規定就是滿一年就有
當場我也告知廠長經理你們這樣已經違反勞基法
結果廠長跟我說你不用跟我講那些拉
我們公司2 30年來都這樣 來不來隨便你拉!!!
既然談判破裂
我也只能告知廠長那我們勞工局講吧!
隨即人資找我做離職訪談
我順便告知人資部門這件事
請公司派員跟我協調時間到勞工局調解 這是勞工局跟我說的
人資小姐跟我說不用 公司沒這規定 她馬上報告總經理特助
沒多久就叫我坐電梯去辦公室喝咖啡了!
特助:我不曉得原來下面基層主管這樣亂搞
公司自古以來一切按照勞基法走 沒什麼一年一個月的事
不用去勞工局 我保證處理好 你相信我!
我:好,那我等特助的回覆.
沒多久 我就放假連七天特休都放完接著隔天離職直接出國
大家要多看熟勞基法 必要時打電話去勞工局詢問
尤其剛出社會的新鮮人
別被某些惡劣的主管騙了
有人也遇到類似情形嗎?
