不知道能不能在這邊詢問...
想請問一下大家
小妹之前擔任業務人員
在去年11月底遭公司資遣
公司資遣的理由是公司縮編、財務困難
沒有任何工作過失
離職時主管有答應要給年終
我有詢問主管是給多少
主管告知還沒到年底結算
所以到時後才和老闆討論
但有請主管寫給年終並簽名
正式離職大概是12月中左右
離職時沒有簽任何文件
1月詢問主管年終的部分
主管line告知年終是1個月
但年資較淺的同事是領2.5個月
我們工作內容差不多
也沒有個人業績
覺得無法接受
打line詢問主管年終計算方式
主管一口說我就是一個月
我一直詢問計算方式
根本鬼打牆對話
主管甚至還語帶威脅說連一個月都不給我
然後掛我電話
到年前最後一個工作日
都沒有收到年終
於是我就是申請勞資調解
調解會時間約是2月中左右
但到場才知道資方請假
而且惡意拖延至4月底
另外公司說財務困難
但發出2.5個月獎金
更資深的領3個月以上
且最近開放職缺陸續應徵新人
根本沒有虧損事實
請問這樣算違法資遣嗎?
現在有打算直接提訴訟
請問大家怎麼樣主張對我比較有利呢?
