拍板一例一休!每月加班上限54小時、3個月138小時內

行政院長賴清德6日中午與民進黨立委召開立法行政協調會報,拍板《勞動基準法》一例一休修法方向。發言人徐國勇會後轉述內容。其中,休息日出勤的工時與工資,改依勞實際出勤時間計算;具爭議的加班時數最終採取乙案,每月加班時間上限放寬為54小時,3個月內仍不得超過138小時;輪換班間隔休息時間可從8小時提高到11小時。
1.為合理規範休息日出勤之工資及工時計算方式,使雇主指派勞工於休息日工作回歸實際需求,將休息日出勤之工作時間及工資之計算,改依勞工實際出勤的時間計算;至其工作時間,仍計入每月加班時數上限。
2.各界對於加班時數多有應允勞雇協商彈性空間之建議,惟各界對於加班時間時數修法建議不一,經粽整大多數意見,擬具甲、乙兩案,最後決定採取乙案:在現行每月加班時數上限46小時維持不變的前提下,新增但書,定明雇主經工會同意,如事業單位無工會者,經勞資會議同意後,得以3個月為週期,一個月的加班時間上限適度放寬為54小時,惟3個月周期內,加班總時數仍不得超過138小時。另外考量雇主僱用30人以上者,影響層面較廣,爰該等雇主依但書規定延長勞工之工時者,併責應報當地主管機關備查。
3.現行輪班制勞工更換班次至少應間隔11小時休息時間的規定,對於勞工身心健康當有助益,惟如一體施行,恐將衝擊現有採行三班制方式輪班之產業。經考量實務運作情形,決定採取乙案:仍以給予連續11小時之休息時間為原則;但雇主經工會同意,如事業單位無工會者經勞資會議同意,得另約定給予適當之休息時間,惟不得少於連續8小時。另考量雇主僱用勞工人數在30人以上者,爰併責應報當地主管機關備查。
4.週休二日新制實施後,勞資雙方均有適度調整例假之需要,為衡平勞資雙方權益、強化勞資對話與協商機制,定明除實施四週彈性工時的事業單位外,雇主經工會同意,如事業單位無工會者,經勞資會議同意後,例假得於每七日之週期內調整。另考量雇主僱用30人以上者,爰併責應報當地主管機關備查。
5.特別休假已休憩為目的,有關年度終結之未休日數,得經勞資雙方協商遞延至次年度實施,惟為確保勞工特別休假權益不因遞延至減損,定明次年度終結或契約終止時,勞工如仍以經遞延但未休畢之特別休假日數,雇主仍應發給工資。
6.定明本次修正條文之施行日期。
