家母所任職的工廠是汐止的一間小間的食品加工廠,
從民國84年就在那邊擔任產線員工至今,整整21年今天被無預警開除
她今天在家裡哭,我聽到真的是非常難過,發誓一定要幫我媽討回公道
教訓惡劣的老闆.也希望有相關經驗的版友也可以指點一下辦法。
以下是該惡質公司狀況簡述
公司規模:17人
所在地:新北市
薪資計算方式:日薪或論件計酬,依工作內容不同來定。家母是日薪
上班時間:早上8:00~17:00 午休1小時,供便當
日薪:900元 平均時薪112.5元/時
全勤:2000元 請假就會扣除,除非病假出示醫生證明免扣
事假就會扣,基本上是看老闆娘心情爽不爽。
星期六要視工廠的訂單與否趕工上班,以今年六月來說工作「23」天。
家母狀況:
1.勞動契約:無
2.薪資證明、扣繳憑單:無
3.退休單/離職單/工作證明… : 無
4.勞健保:無,公司勞保補貼800元讓家母在外面保工會。
21年來無該公司投保記錄,家母84年加入工廠時,因為不確定會待多久
因此沒有加入公司的勞保而是一直在外投保工會,公司補貼800元。
至今年3月,工廠老闆娘跟家母說:「公司投保人數不夠,你去把工會退掉辦退休,
公司幫你保勞健保」於是三月時我親自陪同家母去工會辦了退保退休等程序,
,結果今天家母說:「工廠沒有幫她投保」
5.辭退理由:家母撿貨速度慢,家母對大家很兇態度差
以上指控皆為子虛烏有,工廠有位廠長負責做人員的管理,
這位廠長身為主管職者皆無盡管理職責與人員溝通,
而是今天讓老闆娘無預警的把我媽叫進辦公室,叫她做到今天就好。
未依勞基法規定須提前30日告知
6.資遣費/退休費:無,我媽轉告說:「她跟老闆娘講,這樣做真的讓她無法接受
好歹晚個幾天,對外說是家裡有事不做了,直接開除太不留情面。」
老闆娘聽完回覆說:「不然我包個紅包給你好了」
以上,我媽就這樣什麼都沒的離開了她為了養家活口工作21年的地方
這間工廠,針對做事慢的人從來不留情面,直接叫人走。
1個月內等到貨不趕了,就直接叫你滾。如果今天我媽真的速度慢,會留她21年??!
如果她真的態度惡劣,對人很兇難相處,會留她21年?!?
這間工廠之前曾經有很長的一段時間沒訂單放員工無薪假,要辭退員工隨時都可以
那時怎沒聽他們說我媽動作很慢,要她離職?
工作21年來任勞任怨,連假都幾乎沒在請,印象中請假次數根本不到10次
我開始上班後,多次跟我媽提到工廠違反勞基法的事想舉法,
我媽都阻止說不要這樣,因為她就是個只會憨憨做,憨直純樸的人。
因為學歷不高無專長,無法想像與權威者抵抗會有什麼樣的後果,
總是選擇委屈接受安排…
目前打算向「勞保局與新北市勞工局」申訴
申訴的項目分別是「未投保勞保、違反最低工資、惡意資遣」
是否還有其它是可提及申訴的項目?或是所提出的敘述事證皆不利於家母
如不利家母,還能有什麼辦法嗎?
還懇請具有相關經驗的版友給於建議指教
