簽約毀約相關問題 - 加班

各位板友好,
進入公司半年以來,最近發現了公司很多黑暗面和荒唐的地方。這幾天開始跟同事研究
跟公司簽約之後若想要提前離職的話,要如何才能把毀約金降低的問題。
因為在板上看到有些板友推文說 沒有支付簽約金的話,合約其實就相對無效的說法。
針對這個問題,我今天有撥電到勞工局所提供的免費法律專線去詢問,電話中的律師對
這個情況毫不知情的樣子,他還說我又不是簽給球隊,怎麼會有簽約金這種東西,讓我
懷疑我是不是問得不夠清楚(但已經重複多遍)還是其實有其他附加條件?
我自己是簽了2年的約(薪資單內完全沒有提及簽約金),律師的說法是,因為我是成年
人了,所以簽約了就視同和僱主已經達到共識,跟有無簽約金沒有相關,所以我還是得
賠錢,如果真的要上法院,就只是毀約金金額的調整而已。
題外話:
說到加班,我們公司最近被勞工局罰款到怕了,今年設計了加班申請表,規定我們必須
一天前提出加班申請,並且跟主管報告為何加班(是不是自身效率問題)才能通過。
基本上根本沒人敢申請,大家還是每天都加班到8、9點 哈。
不知道有沒有板友可以提供一些自身的經歷或是看法呢?
