各位鄉民好,
小弟在105/03/28提出離職,
離職日為105/04/29
我的到職日為101/07/17
我們公司特休是用比例算的
所以我今年有10天特休
但是依比例做到4月底有3天特休可以休
剩下7天是不是雇主要轉換成薪資給我?
我去查勞基法看這規定
一,「勞動契約終止時,勞工尚未休完之特別休假如係勞工應休能休而不休者,則非屬歸
責於雇主之原因,雇主可不發給未休完特別休假日數之工資」,所稱「勞工應休能休而不
休者」,係指勞工拋棄特別休假之權利而言,勞工既然拋棄特別休假之權利,則雇主可不
發給未休完特別休假日數之工資。
二,勞工與雇主就特別休假日期協商排定,係為行使勞工之特別休假權利,後因勞工自請
離職勞動契約終止,勞工欲於契約終止前休完未休之特別休假,應與雇主協商,並告知雇
主,並無拋棄權利之意,雇主應以同意為宜;雇主尚不得單方面公告規定「已申請離職之
員工,不可將特別休假調整至離職日之前」,若不同意勞工請求休完應休未休之特別休假
,則應依勞動基準法第二十四條第三款規定發給未休完特別休假日數之工資。
不知道我那7天特休是算應休能休而不休,還是我沒辦法休,我不放棄權利,所以雇主要
轉換成薪資給我?
