台北 某公司
今天公司拿條約要我簽
其中有條契約終止
3.乙方擬於中途解除或終止契約時,除有下列情況外,應於30日前通知早方.
可是勞基法不是規定...
依勞基法自請離職預告規定:
一、繼續工作三個月以上一年未滿者,於十日前預告之。
二、繼續工作一年以上三年未滿者,於二十日前預告之。
三、繼續工作三年以上者,於三十日前預告之。
當公司條約和勞基法 間有相底觸時....是依勞基法吧...

補充 爭取處理: 本契約未盡事宜,悉依甲方有關規章辦理;惟倘有疑義時,
雙方應本諸誠信原則 中華民國有關法令規定公平解決之
,如有爭議涉訟,雙方合意以臺灣臺北地方法院為弟一審管
轄法院..
其他 2 本契約未約定事項,雙方得書面方式另行約定.
中華民國有關法令規定公平解決之 是指勞基法嗎?????
