要離職人資講錯特休 - 離職

我想請問版上各位大大
因為小妹預計在10/31離職,
所以在那之前月底把所有的特休跟本月可休假天數通通排休掉
(服務業用輪休的)
在排假下去之前還有特地Line問過人資,如果我是10/31離職,我還剩多少天?
人資回答我是還有52Hrs
我還特地多問一次,我是10/31離職哦,確定是52Hrs嗎?
人資說 是的
所以我就安心地把我剩下的特休時數通通排下去了
結果剛剛人資才Line我說,他把日期拉錯怎樣的
反正就是我的特休正確應該是只剩下38Hrs才對,這樣我會多休
那我多休的部分要變成我的事假要扣薪
(背後的涵義是:如果變成事假,相對的,我也沒有全勤獎金了)
可是我當初是問過人資我才排假的,
請問我就只能被動接受:人資把我多休的特休變成事假 扣薪扣全勤嗎???
還是我可以拿當初Line的對話紀錄去據理力爭呢??
(我也不知道要依據哪個法條去爭就是了...)
