本人工作性質為美編設計
但工作上屢屢遭到老闆刁難
老闆說因為我產出的圖都不能用所以要再另外找外包,所以是我造成公司損失
因此將我解僱不用給資遣費
如果說是我能力不足因此不適任此工作我也認了沒關係,但這是因為不適任所以是「資遣
」吧?那應該要有資遣費不是?
而說來好笑,老闆聲稱我做的很差的圖其實都跟外包做的沒什麼差別(有拿比對圖給同事
和其他人看過,不是我自稱)
然後被開除了老闆還要我簽自願離職書(他會逼每個被開除的員工都簽,說這是法定離職
手續)但我拒絕了,所以他把自願離職書改成離職切結書,自願的字眼拿掉,雖然我一樣
表示不願意簽,但他大有不簽就不讓人走之勢所以當下簽了。
所以請問這種情形應該是資遣吧?我應該找勞資調解?
