資遣法律問題 - 離職

抱歉想幫朋友問一下
朋友在8/15當天臨時被資遣(年資未滿三個月),
但公司卻說要到8/25才退保,並發給非自願離職證明,
理由是他們要通報勞工局。
但這樣並不合理, 我朋友要到8/25才能去就業輔導站申請失業給付
想請問一下公司這樣合法嗎?
