公司不給特休換錢 - 離職

大家好, 
 
我目前在某老牌集團下的資訊服務公司(上櫃公司)擔任政府標案駐點工程師,
約聘制,年資三年多,年底不再續約故離職,但目前遇到幾個特休爭議:
 
1. 工作時間採輪班制,一個月上12天(6日班6夜班),一天上12小時,因為輪班,
所以特休都沒用過,過去公司會將特休換錢(公司稱「特休代金」)。
 
因為年底離職,所以提前詢問公司特休代金發放事宜,沒想到公司說我們其實沒
有多的特休可轉為特休代金,過去幾年發的為誤發,理由是:
 
「因為上班天數少,所以平常就自動將特休塞到每個月中放掉了,所以沒有剩餘
特休可轉代金」
 
雖然自行上網找資料或是打1955詢問都是得到這點違反勞基法第38條特休由勞工
自行排定的規定,但公司人資依舊堅持(理由是這是由之前部分員工跟公司達成
的協議)。
 
2. 過去幾年發過的特休代金為溢發,將於明年一月於年終獎金內扣除(年終獎金為
勞動契約內明定)。1955專線有說這點也應該是違法,因為不得逕扣不同名目的
錢。
 
 
目前有申請勞資調解了,請問還有什麼辦法可以爭取權利或是讓公司顧忌而不敢違法
行事下去呢?謝謝
