大家好 小弟公司最近要求同仁都簽署一份合約
內容裡面有幾項問題 想請大家幫忙解答 謝謝!!
小弟目前在廣告代銷業 合約甲方為公司 乙方為員工
1.競業禁止:
乙方於任職期間或離職後,不得以自己或第三人名義承攬甲方客戶之業務!!
疑問:代表我就算跳槽到另外一家公司 我也不能幫我以前成交的客戶賣房子?!!
2.智慧財產權:
乙方於任職期間所完成與職務上有關之發明及創作,其智慧財產權皆屬於甲方
另乙方之創作若有侵害到他人智慧財產權情事 皆由乙方負法律責任 與甲方無涉
疑問:這樣要求合理嗎 我在做報表時 創造了快速的作業方式 這樣也算公司的?!!
3.違約:
違反1.者 願無條件賠償甲方新台幣一百萬元作為懲罰性違約金
這樣合理嗎?!!
