公司預給年假 離職後按比例休 這樣合法嗎 - 離職

各位前輩大家好
之前的問題似乎沒有說明詳細
2013/05/06到職 已可以休假七天。
2014 10天年假
2015 10天年假
2016 11天年假
2017/03/31離職 年假3.5天。
請問這是優於勞基法,沒有因為要離職 按照比例給予年假而違法吧?
以前優於勞基法沒錯,但是現在看新舊交界的問題,感覺上現在離職就怪怪的。
