年終問題 - 離職

各位前輩好, 新手小弟有一事請教:
公司老闆因為害怕過年後會有離職潮,
因此今年想出了"年終分梯次發"的想法
也就是每個員工拿到年終的時間不一樣
有的員工可以過年就拿到
但是有的員工還要等到端午才能拿到年終
請問這種作法有違法嗎?
還是身為公司的員工只能默默接受呢?
