知名大公司寄的人事保證書及承諾書 - 離職

大家好,小弟為最南端食品科學系學士畢業,
上禮拜應徵某彰化知名飲料公司的委外品保技術員工作,經筆試面試通過後錄取
昨天18號(三)收到該公司的新進人員通知單,並在23號當天報到繳交相關文件
但對其中幾份文件覺得疑惑,故發文請各位解惑
(1)人事保證書 共九條(其中第一條第9項及第五條)
第一條、甲方自願連帶保證被保證人在乙方或丙方受僱或服務期間(含被保證人於
本約簽約時已或方受僱或服務於乙方或丙方、或於本約保證期間內方受僱
或服務於乙方或丙方之情形)操守廉潔、遵守乙、丙方一切書面或口頭之
規章或規定,被保證人倘有「①②③④⑤⑥⑦⑧、⑨違反乙、丙方之一切
書面或口頭之規章或規定、⑩或有其他情事」(下合稱「保證情事」),
甲方願就①乙、丙方之任一方或全體因被保證人任何「保證情事」所肇致
之一切損失全部、或②被保證人揭所積欠乙、丙方之任一方或全體之「貸
款、借款、暫借款、或其他任何款項」全部,連帶負完全、悉數賠償及償
還之責任,且不以被保證人當年可得之報酬總額為限,另並放棄民法第七
百四十五條之先訴抗辯權。
我想問的是第九項的違反書面或口頭規定的範圍,這界定萬一很寬,不違反法律嗎?
正面是條文,背面還要貼保證人的身分證正反面影本及簽章、通訊地址等資訊。
第五條、被保證人如欲離職,甲方保證並促使其必依相關法令及「乙丙方」內部程序
及規定,事先填載、提出該公司之制式離職申請書向主管提請辭職,並逐級
呈送至「乙丙方」內部規定之公司最高主管。被保證人如違反本約定而致使
乙、丙方之任一方或全體遭受損失時,甲方應連帶負完全之賠償責任。
我想問的是,假設真的要離職,只要走前不要作會損害公司損失的事,就不會害到保
證人,對吧?
承諾書
立承諾書人xxx 現於xx企業股份有限公司任職,立誓遵守公司規定,必要時願受
公司職務調動,並對所支領薪津、獎金、加給、及膳宿津貼等待遇,絕對保密,扣繳憑
單不得轉交他人(人事主管除外)代為辦理綜合所得稅之申報,若有洩密等情事,願受
公司撤職或嚴厲之處分,絕無異議,並願放棄先訴抗辯權,恐口無頻,特立此書為憑。
