試用期、離職跟特休問題 - offer

目前已到職5個多月
offer時約定特休有7天,中間遇到試用期延長一個月的通知
現在的狀況是試用期延長一個月的時間已滿,但公司並未告知我試用的結果(無論是延長、
未過或是在跑簽呈,都未告知)
因為跟剛當初面試的想法不同心裡決定要提離職,故目前未直接詢問主管試用結果
但最近發現勞基法有到職六個月才有三天特休的規定
想請問,就算通過試用期,這樣的狀況會不會變成通過了試用期考核
仍然要滿六個月才能在離職時拿特休換錢?

法的規定不受保障。你可以主張是公司加碼,而公司一
定會說是降低門檻提前給你,但你未滿一年要離職,自
然回歸勞基法規定,勞資調解時委員不會支持你的。
