二月入職,人出差在大陸,已經提早二十天發離職信給直屬主管與人資。
但老闆遲遲不答應,也沒給返台日期
在自保的情況下,可以在離職日後,自行購買返台機票回來嗎?
有沒有需注意的地方呢?

基法,台灣勞基法沒有說可以不預告離職。某人先是搞不
清楚狀況,然後搞不清楚法律,然後被指出來以後拿不出
根據就惱羞成怒。在台灣勞基法的預告期是常識,沒有常
識還沾沾自喜,死不認錯不會讓你的人生變更好。

你我破例一次。1.原po是受雇於台灣企業去大陸出差,適
用台灣勞基法。2.即使是適用對岸法律也是「告知當天就
能走」,告知是必要條件不是你所謂的「有講就很好了」
3.你所謂台灣勞基法說可以不預告離職,是哪一條?雇主
沒有違法前提台灣勞基法哪裡有說可以不預告離職?法條
拿出來啊?叫你拿出來就被你說是HR,你回答得出來嗎?
這種常識問題,正常台灣員工都知道的,在你看來這莫非
是要HR才懂?這條討論串全部都是在打你的臉,再凹下去
是你會更丟臉而已。

預告期限就終止勞動關係。依你的例子應該是前公司沒有
硬要跟勞動者撕破臉所以最終(被迫)同意他直接離開。不
過不照法律規定來就是要承擔相關的風險,如果公司能舉
證因為他的行為造成公司損失的話可以向他求償。不過這
些都不構成「勞基法規定可以不用預告離職」的說法。再
怎麼樣,曠職三天被開除也好,硬跟公司盧就是要走也好
,都算是非常規的方式。以上是非高手雞雞的一點意見。

即使雇主一直沒有答應也一樣,你只要一直跳針說你要幾月幾
號走就好了,然後不斷詢問說交接的事情,交接的部份是要由
資方派人跟你交接或是他們規定的交接格式而不是你自己生,
如果到離職日前還是沒有跟你說交接的事情就不是你的問題了
(但你還是要不斷提醒你啥時要離職以及交接要找誰),離職這
塊是真的比較偏勞方,基本上你有盡到你基本的義務就沒事了
