各位版友大家好,想不到我也有一天需要到版上求助大家QQ
今日下午被上頭叫去談話就感覺不妙了!!
果然因為公司營運不好要被資遣T.T
故事是這樣子的,
因為這是一份有時效性的工作,原本可以做到11月底,我從今年8/9開始上班。
但是上頭叫我選擇做到今天或是做到月底
考量到全勤獎金有2000,所以我直接說做到月底
後來我詢問到資遣費的問題
上頭明確跟我說,資遣費跟離職證明書是二擇一
因為有前三天告知資遣,所以不會有資遣費
或是,不拿資遣費拿離職證明書還可以政府申請失業補助
上頭好心勸我說拿證明書就好別拿資遣費,因為資遣費只有幾百塊
我的問題是:
資遣費跟離職證明書是二擇一嗎?
我不確定最近是否有更改法規,因為兩年前我被資遣時是資遣費跟證明書都有拿
如果確定兩項都能取得,是否有明確的法條可以確認?(第幾項、第幾條)
另外,爬文後,我試著試算資遣費,但是結果都不太一樣= =
因為未滿兩個月所以算法是否為:2/12*0.5*平均薪資?
希望有熟悉勞基法的版友為我解答。謝謝。
