主管想以考績不好逼退我 - 離職

小弟在電子業某公司年資五年,在去年十二月某日
主管突然叫我進辦公室,然後告知我考績排名最後,要我自行離職或
找其他部門。(這是第一次找我)
另外我考績不好,事先都未被告知。
他有列出我績效不好的原因,細心度與態度(態度方面他是用嫁禍的)
並自行決定一個月的觀查期,觀察期有分三次。
第二次以mail告知態度有改進但不持久,只持續了兩週
從第一次到第二次才三週,兩週態度比較好,剩下最後一週我只上班三天
含元旦跟隔日我請假。
其餘的罪證完全是嫁禍方式。
另外我沒有對mail作任何反應。
第三次應該是尾牙當天(1/20)
小弟在這段期間心理壓力非常大,都快去看精神科了
想請問我是否要以勞資爭議向勞工局申訴還是等他資遣?
或是隨時攜帶錄音筆錄到他要我離職的罪證?
但這告到法院也只能判 勞資關係仍存在而已,卻不能對他怎樣?
這主管是新來的主管,職位比我經理還大,連我經理都得聽命於他。
另外這主管已經將另外一個部門的人跟人資聯手全部逼退(含經理,副理)
誰能告訴我該如何作比較好?
